Hire Fees & Security Deposit

To hire the Gas Lift Removal Tool, you will pay:

The $100 security deposit will be refunded (less any applicable additional hire charges or authorised deductions) after the tool has been returned, inspected and confirmed to be in acceptable condition.

How the Hire Works

1. Pay $150.00 plus outbound postage at checkout.
2. We dispatch the Gas Lift Removal Tool to your nominated address.
3. Your hire period begins on the date the parcel is shown as Delivered by the carrier's tracking.
4. The standard hire period is 14 calendar days.
5. When finished, return the tool using a tracked Australia Post or courier service.
6. The return date is determined by the date you lodge the parcel, not the date we receive it.
7. You must email your return tracking number to Kate's Furniture within 24 hours of lodging the parcel. This helps avoid disputes regarding the return date.
8. After receiving and inspecting the tool, we will process any refundable security deposit within 5 business days.

Additional Hire Charges

Your hire fee includes the first 14 calendar days.

If the tool is kept longer, additional hire charges will be deducted from your refundable security deposit.

If the Gas Lift Removal Tool has not been lodged for return within 60 calendar days from the delivery date, the hire agreement will be considered in default.

In this situation:

• The entire $100 security deposit will be forfeited and will not be refunded.
• The Gas Lift Removal Tool remains the property of Kate's Furniture at all times. Forfeiture of the security deposit does not transfer ownership of the tool or constitute a purchase.
• Kate's Furniture reserves the right to request the immediate return of the tool and to recover the tool or seek any additional reasonable costs or remedies available under Australian law.

Returning the Tool

Customers are responsible for:

• Returning the tool using a tracked Australia Post or courier service.
• Packaging the tool securely to prevent damage during transit.
• Emailing the tracking number to Kate's Furniture within 24 hours after lodging the parcel.
• Keeping the tracking receipt until the refund has been processed.

The official return date is the date shown on the carrier's lodgement receipt.

The customer remains responsible for the hired tool until it has been lodged with a tracked postal or courier service.

Once the parcel has been lodged and a valid tracking number has been provided, responsibility for any loss or damage during transit will be determined in accordance with the carrier's investigation and applicable law.

Security Deposit Refund

After the tool has been returned, it will be inspected.

Provided the tool:

• is returned complete;
• is reasonably clean;
• is not damaged beyond normal wear and tear;
• has not been modified or misused; and
• any applicable hire charges have been deducted,

the remaining security deposit will be refunded to the original payment method.

Refunds are normally processed within 5 business days after inspection.

Damage, Loss or Missing Parts

The security deposit may be reduced or withheld if:

• the tool is damaged through misuse, abuse or improper handling;
• parts or accessories are missing;
• the tool has been modified, repaired or altered without authorisation;
• excessive cleaning is required due to grease, paint, adhesives or contamination;
• the tool is returned in an unusable condition.

If the reasonable repair or replacement cost exceeds the security deposit, Kate's Furniture may recover the additional reasonable costs permitted under Australian Consumer Law.

Normal cosmetic wear from proper use will not incur any charge.

Lost or Damaged During Return Transit

If the return parcel is lost or damaged during transit, the customer must provide the tracking number and cooperate with any investigation conducted by the carrier.

Where appropriate, Kate's Furniture will assist by providing information required by the carrier.

Refunds or compensation relating to lost parcels will be determined after the carrier's investigation has been completed.

Incorrect Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If a parcel is returned because an incorrect or incomplete address was supplied, any additional postage costs for re-delivery will be the customer's responsibility.

Safe Use

The Gas Lift Removal Tool is designed to assist with removing office chair gas cylinders.

For your safety:

• Always wear approved safety glasses.
• Wear suitable work gloves.
• Use an appropriate heavy hammer.
• Place the chair securely on a stable surface before use.
• Keep children and bystanders away from the work area.
• Follow the instruction video and any written instructions provided.

Improper use may result in personal injury or damage to the chair, gas cylinder or surrounding property.

Except where liability cannot legally be excluded under Australian Consumer Law, Kate's Furniture accepts no responsibility for injury, loss or damage resulting from misuse, improper use or failure to follow the supplied instructions.

The tool has not been lodged for return by 30 September (more than 60 days).

The hire agreement is in default.

The $100 security deposit is forfeited.

Kate's Furniture may request the immediate return of the tool and may exercise any legal rights available to recover the tool or any additional reasonable costs permitted under Australian law.

Australian Consumer Law

Nothing in this Hire Policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).

Our goods and services come with consumer guarantees that cannot be excluded under the ACL.

This Hire Policy explains the operation of our tool hire service and should be read together with your rights under Australian Consumer Law.

Acceptance of Hire Terms

By placing a hire order, you acknowledge that you have read, understood and agree to this Gas Lift Removal Tool Hire Policy, including:

• the $50 hire fee;
• the $100 refundable security deposit;
• the additional hire charges for late returns;
• the requirement to return the tool using a tracked postal or courier service;
• the requirement to email the return tracking number within 24 hours of lodging the parcel;
• that the Gas Lift Removal Tool remains the property of Kate's Furniture at all times; and
• that failure to return the tool within 60 calendar days will result in forfeiture of the security deposit and may result in Kate's Furniture taking further action to recover the tool or any additional reasonable costs permitted under Australian law.

Customers placing orders through our Shopify website must actively accept these Hire Terms before completing checkout.
